Say WHAT? EPA Says It’s ‘Prohibited’ From Considering Costs When Issuing Air-Quality Regulations

(CNSNews.com) - The Environmental Protection Agency informed Rep. Vicky Hartzler (R-Mo.) in a recent letter that it considers itself “prohibited” by law from considering costs when setting National Ambient Air Quality Standards (NAAQS).

“I received this week a letter from the EPA regarding a letter I’ve written them about some of their rules and they wrote here, quote, ‘Thus, the agency is prohibited from considering costs in setting these standards,’” Hartzler said last week. ”Now in business we do a cost benefit analysis before we make policy changes. Washington should as well.”

“We have got way too many government regulations and we’ve got to get them off the backs of our business owners,” said Hartzler in a Thursday press conference with House Speaker John Boehner (R.-Ohio) and Majority Leader Eric Cantor (R.-Va.). ”The small business administration reported that government regulations are estimated to cost our economy over $1.75 trillion a year and I hear these horror stories on a regular basis from business owners back in my district and yet the bureaucracy seems to be oblivious to the implications of these rules on jobs.”

“We write to you today to express our concern regarding the Environmental Protection Agency’s (EPA) proposed rule to reconsider a recently issued 2008 National Ambient Air Quality Standards (NAAQS) for ground level ozone,” said the letter dated February 23, 2011.

“This action departs from the normal five-year NAAQS review schedule established by the Clean Air Act, a statutory process that includes mandatory reviews of new science and affords multiple opportunities for public comment.”

The letter, provided to CNSNews.com by Hartzler’s press office also said: “According to EPA’s estimate, the 2008 standard requires states and local governments to make significant reductions in ozone at a cost to industry of about $7.6 to $8.8 billion per year. EPA’s new proposal calls for even greater reductions that will cost up to $90 billion per year, per EPA’s own estimates.”

During the summer of 2009, in the early stages of the health care debate, a frustrated Senate Majority Leader Harry Reid, D-Nev., lamented that he wasn’t getting any cooperation from Republicans. “On something as important as health care, you would think people would be interested in working together,” Reid grumbled. “Republicans aren’t interested in working with Democrats. That’s pretty clear. … The party of no is hoping that we trip and fall.”

This “Party of No” rhetoric was parroted by nearly every liberal writer. It is less common today, now that the tables have turned. The new Republican House majority has passed a serious proposal to reform the broken entitlement system and avert national insolvency. Not only has Reid refused to work with the GOP on a budget, but he said it would be “foolish” for Democrats to release one of their own. And last Wednesday, Senate Democrats gave new meaning to the label the “Party of No” when they held a series of four budget votes. Not a single Democrat voted for any budget proposal, including Obama’s own plan, which was rejected by a unanimous 97-to-0 vote.

Democrats have settled on a political strategy of isolating and attacking the Ryan plan instead of offering constructive solutions that could leave them open to attack. If history is any guide, this is a winning election strategy. But it is not necessarily responsible governance. The nation faces an unprecedented debt crisis that makes the problems in the health care system pale in comparison. Both former President Clinton and President Obama at least rhetorically acknowledge that the current and projected federal deficits are unsustainable.

As tempting as it is for Republicans to blast Democrats’ inaction, they would do much better to go on offense and attack the bad ideas Democrats have already embraced. Obama’s still ill-defined plan for reforming Medicare is to strengthen the Independent Payment Advisory Board, a 15-member rationing panel created by Obamacare, so that it can skimp on care for more than 43 million Medicare beneficiaries. Fifty current Democratic senators already endorsed this rationing panel. [Emphasis added]

You need to call Speaker Boehner’s office right now at 202-225-0600 and thank him for the extraordinary step he took this week to slow down President Obama’s radical agenda. [Emphasis added]

With the Obama legislative agenda stalled, the left has turned its attention toward using the Executive power to accomplish their socialist goals. The key to this strategy is to the pack agencies, boards, and commissions such as the National Labor Relations Board and the Consumer Financial Protection Bureau, with leftists like Craig Becker and Elizabeth Warren who will advance the collectivist agenda, regardless of whether there is any legal authority to do so.

The Senate has blocked several of the more radical nominees, but under the Constitution, President Obama has the power to appoint them during a Congressional recess.

Republican Senators warned Obama not to use his recess powers to appoint Becker to the NLRB. He did it anyhow. Becker didn’t disappoint, leading the NLRB to accuse Boeing of violating workers rights by opening a plant in South Carlolina.

Observers expect him to appoint leftists to the Obamacare Independent Payment Advisory Board, they expect him to appoint liberal Peter Diamond to the Federal Reserve Board, along with Warren, Becker, and a host of other leftwing radicals. He can even recess appoint Federal judges to rubber stamp his agenda until the end of the Congress.

Obama needs two things in order to do this – (1) a pen (or, I suppose, an autopen), and a (2) a Senate recess. The Constitution is unclear how long a recess is required. Most constitutional scholars say ten days is the minimum. However, there is almost universal agreement among scholars that a recess of less than three days does not trigger the recess appointment power. In 2007, Reid held “pro-forma” Senate sessions every three days, which successfully prevented Bush from making recess appointments.

Which brings us to another provision in the Constitution. Article 1, Section 5 says “Neither House, during the session of Congress, shall, without the consent of the other, adjourn for more than three days[.]”. This means that without the consent of the Republican-controlled House of Representatives, the Senate cannot adjourn for more than three days, and thus President Obama cannot make any recess appointments.

On Wednesday, 20 Senators led by David Vitter and Jim DeMint wrote a letter to Speaker Boehner asking him to use his authority under Article 1, Section 5 to block the recess appointments.

On Friday, the Examiner reported that Speaker Boehner did not pass a resolution giving the Senate permission to adjourn. Therefore, as he did in 2007, Harry Reid will convene pro-forma sessions today, on Tuesday May 31, and on Friday June 3rd, in order to block his own President from doing recess appointments.

Reid was forced to do this because of the leadership of Speaker Boehner. We must thank our Speaker.

Call Speaker Boehner at 202-225-0600 and thank him for his leadership.

Tell him to continue to refuse to allow the Senate to adjourn for the remainder of the Obama Presidency.

One of my all time favorite blogs,  is Canadian based website Once Upon A  Time In The West.

Based  (like New Zeal) on the premise that communism never died, OUATITW offers great coverage of the resurgent international communist movement and its appendages Islamo- terrorism, narco- terrorism,  Latin American socialism and politically connected organized crime.

In my view, Russia, China, Iran, Cuba, Venezuela, Syria, Nicaragua, Vietnam, North Korea, Brazil, South Africa  and countless other nations, many proclaiming friendship with the West, are all working hand in glove to destroy what is left of the free world.

Most  Westerners can see threats to their liberties from the own governments. Serious as those threats undoubtedly are, they can be overcome by concerted effort b y patriotic citizens.

What we all must wake up to however,  is the fact that the West is now under far more danger from external enemies – led by Russia and China, than we ever were in the deepest, darkest days of the “Cold War”.

Given the chance, (and theymost certainly  are)  this “evil axis” will bring our civilization to its knees.

I am in Washington, D.C. surrounded by expensive SUVs, Hummers, Mercedes, and “environmentally friendly” Priuses sporting stickers with Hope and Change, Socialism 2012,  advertising socialism and communism, to the detriment of the “evil” capitalist system that afforded them those cars and a luxurious lifestyle.

A few beat up cars are liberally covered in communist slogan stickers, phony empty words that promise “redistribution of wealth” and a nanny state. I ponder for a moment if progressives are still waiting for their free gas, housing, day care, jobs, education, medical care, endless vacations, and a chunk of paradise from the “filthy, rotten rich” who deserve to be stripped of everything they own. I still do not understand why they call themselves “progressives” when they are really longing for regression to a life of slavery to the government.

Ardent Democrats and some Republicans believe the rhetoric that a socialist/communist state will bring Shangri La because it will be delivered by a community organizer who has a sonorous voice and reads speeches well. Is it futile to remind them that many countries who have tried the communist model have failed miserably? Millions have lost their lives in re-education camps due to famine, persecution, or refusal to comply with the daily communist indoctrination.

I wished I could take my fellow American citizens back in time to 1977 to show them our life under communism in Romania. Would they wake up every morning at 4 a.m. to stand in line for hours in frigid temperatures until stores opened to fight over an insufficient number of bottles of milk, loaves of bread, or bags of rice, leaving often empty-handed because the supply delivered ran out?

How fun would it be to stand in mile-long lines, winding around blocks? People never knew what was on sale but whatever it was, they needed it so they joined the long lines. We used to carry extra cash and shopping bags just in case we ran into a store that was selling something we needed to survive.

Most basic goods that Americans take for granted, and expect to find on every trip to the store, were in short supply. People fought in lines for the last roll of toilet paper, or the last bag of flour, sugar, or bottle of cooking oil.

Karl Marx made famous the phrase, “From each according to his ability, to each according to his needs.” The country under-produced everything; the central Communist Party planning did not take into account supply and demand; these were elements of capitalism and the evil bourgeoisie. Communist operatives, organizers, and agitators, with no formal education or job experience, were telling the population what it needed. They were crass ideologues who carried the party line.

Before the communists took over the country, first by gentle persuasion, later by force, the country was a monarchy with an abundance of goods, private property, and the opportunity to achieve whatever dreams people had. Some went to school, some became entrepreneurs, and others worked the farmland passed from generation to generation.

Street organizers and thugs convinced some people that it was bourgeois and selfish not to share and distribute the fruit of their labor with the rest of the population.  The rich were evil and deserved to be thrown from power and stripped of their “ill-gotten” wealth. Giving up land and forming co-operatives with shared wealth for all was the only way to achieve happiness.

It had never occurred to people that some individuals worked harder than others did and collectivization would not fare so well, especially after the communists took their lion’s share from the crop. It also never donned on people that the ruling elite would not include themselves in this clever scheme. What was left at the end of the growing season would be equally distributed among the peasants. It was not enough to sustain a family. The men had to migrate to cities and seek jobs in factories. The women and youth were left behind to till the fields and grow the crops. Students were dragged from schools in the fall for one month to pick the crops. It was involuntary “volunteer” work.

People who had more accumulated wealth had to go to jail in addition to having their wealth confiscated because they were bourgeois and a danger to socialist ideology. One of my uncles went to prison for seven years because he had two homes, 10 acres of land, and a mercantile store.

Farmers who refused to lump their land with the collective farms were taken at night into windowless vans, beaten, driven around for hours, and frightened into submission, until they signed their land rights over to the communists. My grandfather was left with a small plot of land in the back of his house and the mud brick home. It was barely big enough to have a small vegetable garden. He rode his bike to work every day, rain or snow, for 45 years because he never had enough money to ride the daily bus, 9 km each way.

The store shelves were empty most of the time; as soon as a delivery was made, it disappeared within minutes, bought by the immediately forming line, or squirreled away under the counter by the vendors themselves wanting to sell at black market prices to those who were willing and able to spend ten times the cost.

I still remember the rationing coupons that looked like postage stamps. They were issued each month. It entitled a family to buy a certain quantity of flour, sugar, oil, butter, or whatever food was in short supply due to the mismanagement of the Communist Central Party committee tasked with keeping the stores stocked. They did make a special effort around Christmas and Easter to have extras delivered to the market in order to keep the masses calm. It was a rare opportunity to buy meat instead of bones to make soup. My mom was a wizard at making a three course-meal out of one chicken if we were lucky to find one.

Communist Party members were insulated from such shortages because they shopped at specialized stores built and maintained just for them. Once a family ran out of rationing coupons, they were no longer entitled to buy in the store; they could go to the black market.

Stealing was common under communism

Stealing was common under communism, from the factory director all the way down to workers. People were forced to steal from work and barter with other people in order to survive. A butcher would steal meat and trade with the baker from a bread factory. Gypsies stole metal and sold it as scrap. They dismantled railroad tracks, metal fences, manholes, cemetery crosses, pretty much anything of metal that was within public reach. A few were electrocuted trying to steal metal from transformer stations.

My dad hated the fact that the work ethic and morals had decayed so much that nobody saw anything wrong with stealing from work in order to survive. The meager salaries did not go very far in spite of the fact that rent, utilities, and prices in general were subsidized by the communist government in order to keep the populace compliant, a not so subtle form of welfare.

Meet ‘Scabby the Rat.’ Over the last 20 years, Scabby and his fellow inflatable rodents have become icons in the world of union protests. With their big, beady red and rubber fangs, unions have found Scabby to be a reliable symbol to protest the use of non-union labor on construction projects. As Scabby’s popularity has grown, the inflatable balloons have begun appearing in other types of labor disputes as well. However, Scabby’s mainstay has been (and remains) protesting the use of non-union labor—the rat being the symbol of the non-union worker and his employer.

Earlier this week, the National Labor Relations Board issued a decision that, while not unexpected given the NLRB’s union extremism, gives unions the unfettered right to display Scabby the Rat and other forms of “banners” (such as a faux coffin and a costumed Grim Reaper) in front of a company with whom the union has a dispute.

More importantly, however, the NLRB’s decision also affirms unions’ ability to use Scabby the Rat in front of a company’s suppliers and customers’ businesses too.

An example of such an incident occurred last year when the Carpenters’ union put up a “shame” banner in front of an ice cream store owned by Navy veteran Greg Steinberger. Steinberger, the owner of Doc Burnstein’s Ice Cream Lab was planning to expand to a mall that was using a non-union drywall company.

The union bannered Doc Burnstein’s for nine months. Luckily for Steinberger, his customers stood by he and his ice cream, even going so far as to protest the union.

“I told one of them, ‘If you’re not going to hell, I don’t know who is,’ ” Lynette Navarro said. “Imagine hurting an ice cream guy whose crime is daring to sign a lease at the mall!”

After the bannering began, irate customers wanted to mount a counter-protest. Steinberger said he consented only because the union action continued through one of his bimonthly blood drives.

“That just really ticked me off,” said Steinberger, who offers a pint of ice cream to every blood donor.

Many companies that are the victims of union bannering are not as lucky. But, of course, the union lawyers at the National Labor Relations Board could care less if small businesses are driven out of business.

In their press release (see full decision here), the union lawyers at the NLRB justified their decision by stating:

The National Labor Relations Act prohibits conduct found to “threaten, coerce, or restrain” a secondary employer not directly involved in a primary labor dispute, if the object of that conduct is to cause the secondary to cease doing business with the primary employer. Under existing precedent,picketing that seeks a consumer boycott of a secondary is usually coercive and therefore unlawful, whereas stationary handbilling with that same object is not, and is therefore protected speech. The question before the Board was where the use of a 16-foot-tall inflatable rat balloon falls on that continuum.

The Board majority – Chairman Wilma B. Liebman and Members Craig Becker and Mark Pearce – found that the balloon display did not involve any confrontational conduct, unlike picketing. Nor was the display coercive in other ways, the majority found. It observed that the union agents involved in the display did not move, shout, impede access, or otherwise interfere with the hospital’s operations.  Rather, the “rat balloon itself was symbolic speech. It certainly drew attention to the Union’s grievance and cast aspersions on [the contractor], but we perceive nothing in the location, size or features of the balloon that were likely to frighten those entering the hospital, disturb patients or their families, or otherwise interfere with the business of the hospital.”

In his dissent, the lone Republican on the NLRB made the following historical argument:

Section 1 of the Act declares the national labor policy of eliminating obstructions to commerce caused by labor disputes.  The Wagner Act sought to achieve that purpose without imposing any restraint on unions’ use of economic pressure to achieve secondary objectives.  This arrangement proved unworkable, and so Congress added the Taft-Hartley amendments in 1947.  Those amendments, which were a response, in part, to abuses of union power, brought needed balance to American labor relations and needed protection to neutral employers, their employees, and customers.

Section 8(b)(4)(ii)(B) deprived unions of a substantial weapon.  No longer could they further their cause in a dispute with a primary employer by picketing “‘to persuade customers of a secondary employer to cease trading with him in order to force him to cease dealing with, or to put pressure upon the primary employer.’  Such picketing spreads labor discord by coercing a neutral party to join the fray.”

Today, the majority puts that neutral party right back into the fray.  Ignoring decades of precedent establishing that bannering is coercive, our colleagues hold that it is mere persuasion and thus lawful.

While the uncertainty over this issue has been lingering for a few years, as noted above, it was not unexpected. The NLRB’s full-fledged union activism has already been revealed in previous cases and will likely continue unless Congress actually does something to stop it.

In the meantime, there is one company owner who is probably thrilled with the NLRB’s decision. That is, Mike O’Connor, owner of Big Sky Balloons & Searchlights in Plainfield, Illinois. Mike is Scabby the Rat’s maker.

Ironically, Big Sky Balloons, the maker of the unions’ now famous rodent, is a non-union company.

About 20 years ago, Don Newton, a union bricklayer, Chicago bricklayers union, commissioned Big Sky Balloons & Searchlights in Plainfield, Illinois, to create the proto-rat. Newton deemed Big Sky’s first attempt “not mean enough,” so fangs and “festering nipples” were added.

But, as with most things controversial, there’s an odd little twist in the story:

Big Sky Balloons & Searchlights (which also makes skunks, greedy pigs, and corporate fat cats in addition to rats), is a non-union shop.

So, the question is, how long before one of Big Sky Balloons’ inflatable rats gets set up outside Big Sky Balloons?

When Paul Ryan’s budget bill failed to pass in the Senate and there were reports that five Republican Senators joined the Democrats and voted against it, it only took a few seconds to guess three of the five.

All I had to do was think of the Progressive (Socialist) Democrats who are posing as Republicans.

The two Maine(iac) Progressive Senators, Olympia Snowe and Susan Collins, were at the top of my guess list and next was the Progressive Massachusetts Senator, Scott Brown.

Alaskan Senator Lisa Murkowski was the fourth Republican to vote against fiscal sanity for our country. The fifth Republican Senator who voted against it – Rand Paul – really surprised me. After a little research, I learned that he voted against it because he submitted a budget bill of his own that would yield even deeper cuts to the out-of-control spending in Washington. So Rand Paul’s vote was completely understandable, but if it had been a deciding vote, he would be toast in my book.

The Progressives (Socialist Democrats) framed the debate over Paul Ryan’s budget bill as “killing Granny” by using the old “Medi-scare” propaganda.

Through Obamacare, the Socialist Democrats, including Obama and his administration, are cutting half a Trillion dollars out of Medicare. They’re robbing Medicare to cover the cost of the massive bureaucracy and data-collection effort (to invade our privacy) required by Obamacare. Also, they need money to cover the cost of a 15-person panel of un-elected bureaucrats who will decide if Granny and Gramps can have the treatment they need.

Could this be the “death panels” Sarah Palin talked about? You Betcha!

Good luck Granny and Gramps… Your chance of getting what you need through Obama’s 15-person panel is slim to null and anyone paying attention to the facts knows this is true.

Claiming the Republicans are doing what the Socialist Democrats are actually doing is the typical propaganda strategy we’ve been seeing for many years. Why have the Socialist Democrats stuck with it? Because, unfortunately, it works.

It’s heartbreaking that many Americans are so uninformed that they actually believe the left-stream media and the lying Socialist Democrats.

As long as Obamacare remains the law of the land, Americans will suffer from its regulatory governance. Once it’s fully implemented, Americans will finally understand how dangerous it truly is.

Back to the rest of the Republican budget bill… the choice was clear. Do we allow Obama and the Socialist Democrats to continue to spend us into oblivion, collapse our economy, usher in a global currency, a Socialist re-distributive system of “global governance” under a totalitarian communistic regime, and cede America’s sovereignty to the New World Order – which ObamaGeorge Soros and the United Nations (UN) openly talk about?

Or do we support the Republican plan to cut the out-of-control government spending in order to right the ship and steer us toward reviving our collapsing economy and our free market system?

Senators in the Socialist Democrat-controlled Senate voted to stand on the side of Obama and elected officials who want to collapse our economy, destroy our way of life and institute tyranny. (If you thought being molested by the TSA was bad, you ain’t seen nothin’ yet!)

Now that we’ve heard from the traitorous Senators we elected, let’s hear from you. Where do you stand?

The choice is clear. Do you stand with the Socialist Democrats who intend to change life as we know it by transforming it into the oppressive and failed systems other countries have tried? For people who don’t think it’ll be worse, consider this question… What do you think Obama means when he says everyone has to participate in “shared sacrifice”? Do you honestly think he means everyone but you?

47% of Americans who don’t pay any taxes and those who receive government assistance should be extremely concerned if the Socialist Democrats are successful. What they’re doing guarantees that you will have to participate in the “shared sacrifice” (you will have to work and pay taxes to feed the government beast), and your checks and debit cards will stop flowing. No doubt about it. [Emphasis added]

However, if you stand on the side of cutting the massive, unsustainable Washington spending, you stand with America and all that has made her the greatest, most prosperous and giving nation on the planet.

The political left is composed of the real racists and reactionaries. Every election cycle they try to cobble together a collection of racial, ethnic or other special interest groups and union members, not because they are disadvantaged or disenfranchised, but because they are disgruntled.

It is the politics of division, not unity; of racial and ethic stereotypes, not what binds us; of coercion, not freedom of choice.

The left’s delusions about themselves never translate well into sensible policies or laws because they tend to think with their glands and imagine other people’s money as their own.

Both Obama and his minions see him as the reincarnation of Abraham Lincoln. A more accurate likeness would be Robert Mugabe of Zimbabwe.

In actuality, progress is an anathema to the left because as soon as individuals from any group improve their lives, they begin to migrate away from the left-wing.

So, in order for the left to maintain a constituency, they promote racial and ethnic polarization, exploit frustrated blue collar workers and open the borders to illegal immigration. The left can only survive through unhappiness and pessimism.

We know that the MSM is hopelessly biased. They will always give liberals flattering coverage and attack conservatives even with misinformation or outright lies. They will actively conspire to support Democrats and attempt to influence Republicans to choose the weakest candidates.

We know that the Republican leadership will work with the MSM to discredit any Republican candidate, who might offer real change. The Republican elite would rather lose an election than risk losing the benefits of political cronyism.

We know that there is no longer any real difference between the Republicans and Democrats. They have become a permanent professional political class, which represents no one but themselves. They are accomplices in the dismantling of our Constitution and the decline of our country.

We know there will be no meaningful change in Washington, D.C. unless the American people rise up in anger, destroy the permanent professional political class and replace it with citizen-legislators bounded by term limits.

Those complicit in the Obama cover-up will be the first to go.

We know that you have been lying to us to protect your own butts.

We will no longer accept the same gaggle of unresponsive and compromised Republican candidates proffered by the entrenched political elites and their co-conspirators in the MSM. We would rather stay home on Election Day 2012 than continue the pretence of honest government.

The outrage is growing and the winds of change are blowing. You may not feel it yet in Washington, D.C., but you will.
