Obama’s NLRB Unleashes Ambush Elections on America’s Job Creators

On Monday, April 30th, Barack Obama’s union-controlled National Labor Relations Board will be imposing its new union election rules, designed to ambush unsuspecting employers. Since unions won over 71% of the 1595 NLRB-conducted elections in 2011, the NLRB’s radical departure from past precedent is neither necessary, nor warranted. Moreover, given unions’ legal ability to deceive workers into unionizing, it is believed the NLRB’s doing union’s bidding will result in smaller companies and their employees falling prey to unionization.
While the NLRB’s purported ‘streamlining’ of its election procedures seems simple, to those who have experienced the tumultuous time when a union has targeted a company, the ability of the union-controlled NLRB to now eviscerate employers’ ability to challenge the validity of a union’s attack through a fair hearing opens the door to a drastic reduction of time an employer has to respond.
The Associated Builders & Contractors, an association of predominantly union-free contractors, sums it up this way:
Under the rule, commonly known as the “ambush” elections rule, the amount of time between when a union files a representation petition and an election takes place is reduced from the current average of around 40 days to as few as 17 to 20 days.
The NLRB achieved this drastic reduction in time primarily by:
- combining pre- and post-election appeals;
- truncating pre- and post-hearing procedures; and
- limiting the types of issues an employer can raise at a pre-election hearing. (Determining which employees are considered supervisors, and which employees constitute a potential bargaining “unit” are no longer permitted before the election takes place.)
While many larger employers have the resources to preemptively insulate their organizations from union attack, many smaller employers and their employees have suddenly become hugely vulnerable.

Hilda Solis also enjoyed strong union and Communist Party USA backing when she ran for U.S. Congress in 2000.
In a report submitted to the Communist Party in November 2000 Evelina Alarcon, Vice Chair CPUSA and Chair Southern California District, commented on Hilda Solis’s Congressional victory;
- The monumental victories which are occurring in Los Angeles electorally and in the workplace are because of the coalition building that the labor movement is doing with the Latino and African American community. - Saturday evening delegates recognized the contributions of DSA vice chair and Washington Post]columnist Harold Meyerson, Occidental College sociologist and longtime DSAer Peter Dreier and insurgent California Congress member Hilda Solis (D) who in turn provided in-depth perspectives of the political scene.
Other speakers included ACORN chief organizer Wade Rathke, Kent Wong of the UCLA Labor Center and Roxana Tynan of the Los Angeles Alliance for a New Economy.[6]

Second Cuba Trip
From Dec. 15 – Dec. 18, 2006, a Congressional Delegation of ten congressmen and women from the U.S. House of Representatives visited Havana, Cuba. Leading the delegation were Jeff Flake and Bill Delahunt. The other participants were Hilda Solis, Jo Ann Emerson, Jerry Moran, Michael Conaway, Jane Harman, Lincoln Davis, Gregory Meeks and Jim McGovern. The delegation met with Cuban Foreign Minister, Felipe Perez Roque and other communist officials. The delegation asked to meet with Raul Castro during their weekend visit to Cuba, but there was no word on whether such a meeting would take place.[9]

The U.S. Department of Labor (DOL) internal document excerpted below supports the allegation that Obama appointee John Lund has told union officials to ignore federal investigators and deal with him personally. His actions irreversibly taint criminal investigations and subvert employee protections in favor of union bosses, while raising the prestige of his labor consultant team in Wisconsin.
More importantly, union members and those forced to pay dues to these unions would likely be painted as victims that they are. Perhaps the press would even look back at the last three years of union disclosure elimination that John Lund has orchestrated that has no benefit for the rank-and-file. No, Lund has been systematically dismantling union financial disclosure and union boss conflict-of-interest reporting to the benefit of his union boss clients.
As OLMS Director, Lund wields the power to instigate, influence and/or shut down criminal investigations or union audits. This kind of authority requires responsible oversight and unimpeachable ethical standards, which, it appears, are not being maintained, and thus destroying public confidence in the integrity of OLMS.
According to the official DOL minutes excerpted above, Lund is not only “directly” providing his personal services to delinquent union disclosure filers, but he has also instructed union officers “not to deal with OLMS investigators.” If this does not violate federal employee ethics, then there are no federal employee ethics.
