Obama Administration rushing policies to kill coal power after Nov. 6

The Obama administration is rushing to finalize regulations that will effectively kill coal power in America, the Washington Examiner reported:

President Obama’s Environmental Protection Agency has devoted an unprecedented number of bureaucrats to finalizing new anti-coal regulations that are set to be released at the end of November, according to a source inside the EPA.

More than 50 EPA staff are now crashing to finish greenhouse gas emission standards that would essentially ban all construction of new coal-fired power plants. Never before have so many EPA resources been devoted to a single regulation. The independent and non-partisan Manhattan Institute estimates that the EPA’s greenhouse gas coal regulation will cost the U.S. economy $700 billion.

The rush is a major sign of panic by environmentalists inside the Obama administration. If Obama wins, the EPA would have another four full years to implement their anti-fossil fuel agenda. But if Romney wins, regulators will have a very narrow window to enact a select few costly regulations that would then be very hard for a President Romney to undo.

The same Manhattan Institute report also notes that the new EPA regulations will not actually cut greenhouse gas emissions and that new coal power plants are clean by the usual EPA standards.

The Virginia Department of Mines, Minerals, and Energy points out coal’s importance to Virginia’s energy profile:

Coal is the most valuable single mineral resource produced in Virginia, with an estimated value in 2006 totaling $1.7 billion.  During 2006, about 29.5 million short tons of coal was mined. … Virginia consistently ranks among the top ten coal-producing states in the nation, making it an important contributor to the U.S. energy profile.

Virginia Republican Gov. Bob McDonnell has complained in the past to theWashington Free Beacon about the Obama administration’s energy policies:

“Stop coming up with silly and unbalanced policies that hurt the ability of Virginia to use all of its God-given natural resources.”

Waging War on Coal

EPA haze plans designed to circumvent court rulings

The Environmental Protection Agency (EPA) has expanded its control of state regulations known as Regional Haze Rule in order to impose more stringent regulations on coal-fired power plants and avoid the judicial injunction against air quality regulations that it tried to impose in 2011.

The EPA imposed haze plans on North Dakota, New Mexico, Oklahoma, and Nebraska in 2011 and 2012 that will increase energy compliance costs by almost $375 million. It also rejected plans in Wyoming and Arizona, demanding stricter regulations that would add at least $200 million to energy production, according to William Yeatman, an environmental regulations expert at the Competitive Enterprise Institute.

“Ultimately every state will face this; Ohio, Pennsylvania, everyone,” Yeatman said. “The EPA positioned Regional Haze to stand in for other regulations that didn’t pass constitutional muster. It is clearly moving aggressively to extend these rules to all coal-fired plants.”

The EPA attempted to usher in new regulatory processes for coal with the Cross State Air Pollution Rule, which would have enabled the department to cap emissions for power plants operating in the states because pollution can travel across state lines. A federal appeals court blocked the rule from taking effect in 2011 and struck it down in August 2012, citing the rule’s onerous requirements and regulatory overreach.

The courts may have thwarted the rule from taking effect, but that did not prevent the department from using its costly guidelines on existing regulation such as the Regional Haze Rule, a 1999 standard that requires states to enhance visibility in federal parks. The EPA allowed the states to count existing air quality standards, such as the Clean Air Interstate Rules, toward its haze plans.

The EPA replaced the Clean Air Interstate Rules baseline with the more stringent Cross State Air Pollution Rule in May 2012 despite being on shaky legal ground. The agency then assumed the authority not only to approve haze plans, but also to replace them with federal plans if states refused to comply.

“EPA has been working with all states to take action on their regional haze plans for protecting visibility in our national parks and other areas. Most of these actions have been approvals,” spokeswoman Enesta Jones said.

Mark Lewis sits on the board of the Central Arizona Project, a public water management system that relies on the Navajo Generating Station’s coal plants to pump water throughout the state. He said the Regional Haze Rules proposed by the EPA would “destroy 65 years and $4 billion of infrastructure investments” because they would force the Navajo Station to spend $1 billion on upgrades. This has left the state no choice but to challenge the haze rules.

“This is targeted to shut down coal plants and they’re going to end up bankrupting the largest tribe in the country, as well as the farmers that use it for their water supply and the taxpayers who use it for electricity,” he said. “The EPA and environmental activists have overplayed their hands in these job-killing regulations.”

OBAMACARE RULES TO BE UNLEASHED AFTER ELECTION

President Obama has not talked about ObamaCare much during the campaign, understandably because most Americans want the health care law repealed. But just wait. We’ll be hearing a lot more about the president’s signature legislation, because a “flood” of ObamaCare rules will be unleashed upon us immediately following the election.

While Barack Obama has been on the campaign trail, HHS Secretary Kathleen Sebelius and her staff, along with those at the state level who are decision-making about the “exchanges,” have been busy working behind the scenes preparing for the “big reveal” of regulations.

On November 16th, the states face a deadline to inform the Obama administration whether they will implement the health insurance exchanges where consumers will purchase health insurance after 2014. States must have the exchanges ready to go in late 2013. If Obama wins and Democrats are still in control of the Senate, they will be sure the law is put in place as soon as possible.

With a Romney win, the lame duck session will not be so lame. Democrats will likely scramble to get all the regulations finalized by Nov. 22nd, which will be the 60-day mark before Romney’s inauguration on Jan. 20th. For the Obama administration, a “finalized” rule is one that cannot easily be undone by a Romney administration.

Perhaps one of the most significant, and controversial, ObamaCare regulations to be issued is one that will dictate what health insurance plans must cover. Other final rules to be issued include those governing the health insurance exchanges, the individual mandate, employer penalties with regard to insuring “full-time” employees, and the now notorious HHS “contraception” mandate.

Regarding the likely onslaught of ObamaCare rules, Gail Wilensky, who has overseen the Medicare and Medicaid programs under President George H.W. Bush, “My expectation is we will see a flurry [of regulation releases], but we’ll see the biggest flurry if Obama were to lose.” If Obama loses the election, time will not be on his side.

But, how will ObamaCare affect the pocketbooks of consumers who purchase health insurance in 2013? According to Ralph J. Nicoletti, Chief Financial Officer for Cigna, taxes on the health insurance industry related to ObamaCare will be passed on to customers in the form of higher premiums.

If some of the coal miners standing with Mitt Romney in his new campaign ad don’t look happy, it’s probably because they’re not.

The campaign pulled the footage for its new “War on Coal” spot from a recent Ohio rally that some coal miners complained they were forced to take a day off without pay to attend.

RT TV also reported: Miners forced to attend Romney’s rally.

The coal miners from the American Energy Corp. Century Mine told Obama and the media to stop telling “absolute lies”.  Obama’s TV ad  essentially accuses miners of being props  for Romney, but the miners were not forced to attend the Romney rally by the mine’s owner, Robert Murray.

Miners held a press conference to release a letter signed by over 500 miners saying they were not forced to attend Romney event. They wanted to attend because there is a war on coal and Obama is leading it. If Obama is re-elected he will put us all out of work permanently.

We’ve previously told you about the war that Barack Obama is waging on the coal industry. His declaration that he wanted to bankrupt coal plants apparently didn’t phase Ted Strickland, who is out there making a fool of himself by claiming that Obama is actually a friend to coal.

Now fellow Ohio Democrat Sherrod Brown has joined Obama in the trenches to destroy coal jobs and cheap energy for Ohioans, who get 86% of their electricity from coal. One of Obama’s new regulations abuses executive power and is called Utility Maximum Achievable Control Technology, or Utility MACT. It would make the building of new coal plants an impossibility and cost existing plants tens of billions of dollars to retrofit their systems. Many will choose to just close down like six of FirstEnergy’s plants. And, just like Obama predicted, and desires, MACT will cause electricity rates to necessarily skyrocket.

Wednesday, the Senate held a vote on a resolution that would have overturned Utility MACT. However, S.J. Resolution 37 failed by four votes. Sherrod Brown once again stood with Barack Obama and his extreme ideology, and sent a message to Ohioans that coal jobs and affordable energy just aren’t as important as towing the line for Barack Obama.

Obama’s war on coal hits your electric bill

Obama’s War on Coal has already taken a remarkable toll on coal-fired power plants in America.

Last week the U.S. Energy Information Administration reported a shocking drop in power sector coal consumption in the first quarter of 2012. Coal-fired power plants are now generating just 36 percent of U.S. electricity, versus 44.6 percent just one year ago.

It’s the result of an unprecedented regulatory assault on coal that will leave us all much poorer.

Last week PJM Interconnection, the company that operates the electric grid for 13 states (Delaware, Illinois, Indiana, Kentucky, Maryland, Michigan, New Jersey, North Carolina, Ohio, Pennsylvania, Tennessee, Virginia, West Virginia and the District of Columbia) held its 2015 capacity auction. These are the first real, market prices that take Obama’s most recent anti-coal regulations into account, and they prove that he is keeping his 2008 campaign promise to make electricity prices “necessarily skyrocket.”

The market-clearing price for new 2015 capacity – almost all natural gas – was $136 per megawatt. That’s eight times higher than the price for 2012, which was just $16 per megawatt. In the mid-Atlantic area covering New Jersey, Delaware, Pennsylvania, and DC the new price is $167 per megawatt. For the northern Ohio territory served by FirstEnergy, the price is a shocking $357 per megawatt.

Why the massive price increases? Andy Ott from PJM stated the obvious: “Capacity prices were higher than last year’s because of retirements of existing coal-fired generation resulting largely from environmental regulations which go into effect in 2015.” Northern Ohio is suffering from more forced coal-plant retirements than the rest of the region, hence the even higher price.

These are not computer models or projections or estimates. These are the actual prices that electric distributors have agreed to pay for new capacity. The costs will be passed on to consumers at the retail level.

House Energy and Power Subcommittee Chairman Ed Whitfield (R-Ky.) aptly explained: “The PJM auction forecasts a dim future where Americans will be paying more to keep the lights on. We are seeing more and more coal plants fall victim to EPA’s destructive regulatory agenda, and as a result, we are seeing more job losses and higher electricity prices.”

The only thing that can stop this massive price hike now is an all-out effort to end Obama’s War on Coal and repeal this destructive regulatory agenda.

The Senate will have a critical opportunity to do just that when it votes on stopping Obama’s most expensive anti-coal regulation sometime in the next couple of weeks. The vote is on the Inhofe Resolution, S.J. Res 37, to overturn the so-called Utility MACT rule, which the EPA itself acknowledges is its most expensive rule ever.

This vote is protected from filibuster, and it will take just 51 votes to send a clear message to Obama that his War on Coal must end.

Of course, Obama could veto the resolution and keep the rule intact, although that would force him to take full political responsibility for the massive impending jump in electricity prices.

WASHINGTON –  House Democrats joined Republicans Friday in voting to restrain environmental regulators from hurting the coal industry, battling what mining-state lawmakers call a “war on coal” that just cost another 1,200 jobs.

The 233-175 vote to approve the “Stop the War on Coal Act” marked the final vote in the chamber until mid-November. Nineteen Democrats joined the majority in voting for the bill.

The proposals would bar the Environmental Protection Agency from restricting greenhouse gases, quash stricter fuel efficiency standards for cars and give states control over disposal of harmful coal byproducts. The vote coincides with a fresh campaign-trail effort by Mitt Romney to hammer President Obama over the impact the EPA’s policies have had on the industry. It also comes after company Alpha Natural Resources announced earlier this week that it was eliminating 1,200 positions, closing eight coal mines across three states. The company cited a difficult market in which power plants are switching to abundant, less-expensive natural gas and “a regulatory environment that’s aggressively aimed at constraining the use of coal.”

House Speaker John Boehner, in a statement Friday on the vote, blamed the “war on coal” for the job loss and said the House bill reins in the administration’s most damaging new energy regulations and holds them accountable for the economic impact of several others.”

The legislation, though, is dead on arrival in the Democratic-led Senate, and Obama has already threatened a veto should it ever reach his desk.

Republicans and conservative groups are working to saddle down-ballot Democrats with Obama’s environmental policies, which are unpopular in energy-producing battleground states such as Virginia and Ohio. They argue that no source of jobs or affordable energy can be spared amid a still-weak economy, with unemployment at 8.1 percent, and reliance on oil from the tumultuous Middle East.

New fuel economy standards that cut tailpipe emissions — set for model years 2017-2025 — would be gutted by the act. So would the EPA’s ability to regulate gases blamed for global warming. A 2007 Supreme Court ruling cleared the EPA to regulate greenhouse gases under its authority to control air pollutants, but the legislation amends the Clean Air Act to preclude any taxes or regulations on greenhouse gases.

Another provision would forbid the Interior Department from issuing any new rules that threaten mining jobs or U.S. coal production through the end of 2013. The package also would create a new agency to study how EPA rules harm jobs and energy prices.

The measure also would give states broad control over disposal of coal ash, a waste product from power plants, and protection of water quality near mining operations. Also nixed would be EPA standards for mercury and air toxins and a “good neighbor” rule that protects states that are downwind from polluting power plants.

Rep. Bill Johnson, who authored the act, challenged Obama to follow through on his State of the Union vow to support an all-of-the-above approach to American energy.

“This is not about climate change,” said Johnson, R-Ohio. “If it’s a public health, public safety, national security issue, certainly common sense regulations are appropriate. Regulations that are based on fact and science — not based on political rhetoric or an environmentalist agenda.”

Consol idling W.Va. mine, laying off 318 workers

Consol Energy Inc. will idle its Fola coal mining operation near Bickmore in central West Virginia on Aug. 30 because of poor market demand and regulatory pressures.

The shutdown will affect 318 employees, the Cecil-based company said on Friday. The workers, who are nonunion, include surface and underground miners, and reclamation and office staffers.

Consol expects 2012 production to be reduced by 800,000 tons. So far this year, the Fola complex has produced more than 1 million tons of coal.

“The domestic market for coal remains soft, due to weak economic growth and activity,” said President Nicolas DeIuliss in a statement. He also cited the “escalating costs and uncertainty” generated by pending regulations from the Environment Protection Agency as a reason for idling the mine operation.

“Consol over the years has been disciplined in adjusting its production to the market,” said Thomas Hoffman, energy communications consultant in Upper St. Clair.

“It’s a very, very challenging market right now for coal producers. Consol is not unique to idling production,” said Hoffman. “Patriot Coal, Peabody, Alpha Natural Resources and others all have either closed or idled mines within the last few months.”

Earlier this year, Consol idled two mines for several months — in West Virginia and in southwest Virginia — because of weak demand for steam coal for power generation and for metallurgical coal for steel making.

DeIuliss said there is “significant uncertainty” about whether power companies will continue to use central Appalachian coal in their plants.

For more than a decade, coal accounted for 48 percent of the feedstock for American power generation, Hoffman said. The percentage this year has declined to about 38 percent, partly because of utilities’ switch to cheaper natural gas.

Further, the price of coal used for power generation has dropped by more than 30 percent from a year ago, Hoffman said.
