Obama Administration Undermining Work Requirements for Welfare Recipients

Yesterday, the Department of Health and Human Services (HHS) issued guidance” to states that could undermine the work requirements introduced in the 1996 welfare reform. The HHS guidance explains how states can seek “waivers” of work requirements for recipients of the Temporary Assistance for Needy Families (TANF)program. But there has been no change in the TANF law, no proposal from the Obama administration to change policy, and no basis in statute for the changes.
The House Ways and Means Committee Chairman Dave Camp (R-MI) and Senate Finance Committee ranking member Orrin Hatch (R-UT) have sent a letter to HHS Secretary Sebelius seeking an explanation for what appears to me to be a lawless power grab. Rep. Camp summed it up: “This is a brazen and unwarranted unraveling of welfare reform. This ends welfare reform as we know it.”
There can be no mistake now: the Obama administration is seeking to create a permanent majority of Americans receiving money from taxpaying, working Americans. Food stamps are hyped through advertising, work requirements are being sabotaged (contrary to law), unemployment insurance extended for years.
If you work hard, pay taxes, and obey the law, you are a target. If you give up, call yourself a victim, and demand money that other people earned, you are part of the new dependant majority that will keep Democrats in power forever, or so they must hope.

The Department and Health and Human Services announced the agency will issue waivers for the federal work requirement of the Temporary Assistance for Needy Families (TANF) program — considered a central facet of welfare reform in 1996 — Thursday.
The “Information Memorandum” states that the agency will be issuing waivers for TANF’s work participation requirements for parents and caretakers as a way to find new approaches to better employment outcomes.
The move has some concerned, however, that the Obama administration is weakening or even violating the welfare reform law of 1996.
According to Republican Study Committee Chairman Jim Jordan, the memorandum is proof of the Obama administration’s continued disrespect for the rule of law.
“President Obama just tore up a basic foundation of the welfare contract,” Jordan said in a statement. “In exchange for taxpayer-funded TANF payments, the law calls on able-bodied adults to work, look for work, take classes, or undergo drug and alcohol counseling. It’s the tough love that gives people motivation to help themselves…Today’s action is also a blatant violation of the law. After immigration, education, marriage, and religious conscience protections, we can now add welfare reform to the list of laws President Obama refuses to follow.”
“The new welfare dictate issued by the Obama Administration clearly guts the law,” Rector and Bradley wrote at The Foundry. “The Administration tramples on the actual legislation passed by Congress and seeks to impose its own policy choices—a pattern that has become all too common in this Administration. The result is the end of welfare reform.”
After the rule change, House Speaker John Boehner released a statement condemning the move.
“By gutting the work requirements in President Clinton’s signature welfare reform law, President Obama is admitting his economic policies have failed,” Boehner wrote.
“While President Clinton worked with Congress in a bipartisan way on welfare reform and economic opportunity, President Obama has routinely ignored Republican proposals, rejected House-passed jobs bills, and imposed an agenda that’s helped keep the unemployment rate above eight percent for 41 months. Instead of working with Republicans to boost job creation, the president is simply disregarding the requirement that welfare recipients find work,” he continued.
Boehner concluded, “Welfare reform was an historic, bipartisan success – this move by the Obama administration is a partisan disgrace.”
ART CASHIN: The Unemployed Are Now Going On Disability And It’s Costing The Government Billions

In this morning’s Cashin’s Comments, Art Cashin points to some disturbing research regarding the recent bump in disability benefit applications:
I’m Sick Of Being Unemployed – A couple of strange and rather disquieting reports circulated among the Friends of Fermentation yesterday. The topic was unemployment or, more specifically, where do those people go who have stopped looking for work. Their absence is credited with distorting the unemployment rate and making it lower than most expect or believe.
The reports I allude to, contended that many went on disability. In fact, they projected that nearly 25% of those not actively seeking a job had applied for, and been accepted, by disability – mostly Social Security.
One of the reports came from a site called SoberLook.com (a perfectly logical place for the Friends of Fermentation to be browsing). The Sober report quoted extensively from a report by JPMorgan. I was unable to locate the original JPM report but we’ll assume that Sober quoted from it correctly. Anyway, here’s a bit from SoberLook:
But how does one survive after losing the unemployment benefits? Clearly people struggle. One way to pay the bills however is to file for and receive the federal disability benefits – assuming of course one has a disability. Interestingly enough, the Great Recession and the slow recovery somehow generated many more disability recipients.
JPMorgan: As of January over 8.5 million individuals were receiving federal disability payments (an additional 2 million spouses and children of disabled workers also received disability payments). Since the onset of the recession and the subsequent slow recovery, this figure has accelerated and grown faster than the overall size of the potential labor
